Service Station A
proposal for the redevelopment of the Chevron Station several months
ago. The following variances were requested to accommodate the
proposed development.
1) Off-street parking - 25 proposed versus 27 required. 2)
Curb cuts - one on each street proposed versus two on each street
required. 3) Loading zone - use of dumpster access versus one
loading zone. 4) Front setback - placement of gas pump canopy
25.9 feet from front lot line versus 30 feet required (variance
of 4.1 feet). 5) Rear setback - placement
of new building 7 feet from rear lot line versus 25 feet required
(variance of 18 feet).
These
variances were granted by the Board of Adjustment on January 18,
2007. As allowed by Town codes, a request to reconsider the
variances granted for the development was received. The Board of
Adjustment considered the request and granted the re-hearing. In
response to this action by the Board of Adjustment, litigation was
filed against the Town of Melbourne Beach by the owner of the
Chevron Station. In order to settle the litigation, the Town
Commission took action on November 13, 2007 to restore the variances
as originally granted by the Board of Adjustment. (Updated
