Information on Running for Office-

2009 Election:
General Election - Tuesday, November 3, 2009

Elected candidates shall take office at the beginning of the next official meeting following the municipal election at which they were elected. (Wednesday, November 18, 2009, 6:30 p.m.)

Offices Open- (2) Commission Seats, currently held by Commissioner Guglietta and Commissioner Evans

Term of Office - Three years, through November 2012.

Qualifications - Members of the Town Commission shall have been residents of the Town for at least six months prior to the date of qualification for office and shall have the qualifications of a Town Elector (18 years of age and a registered voter).

Nominating Petitions - Every candidate for elective town office shall file with the Town Clerk a petition signed by not less than 25 qualified electors of the town requesting the Town Commission to place the name of such candidate upon the official ballot. Extra signatures should be obtained in the event some citizens are not qualified. Qualified electors may only sign one petition.

Qualifying Fee - $10. In addition, the State of Florida Department of State requires an assessment of one percent (1%) of the annual salary of the office being sought. The Commission's annual salary is $3,100, which equates to a $31 assessment. [Florida Statutes 99.093(1)] Total fee is $41.00.

Qualifying Period – August 6, 2009 (89th day prior to Election) through August 18, 2009 (77th day prior to Election) at noon.

Candidates shall file qualifying papers and qualifying fee with the Town Clerk. Qualifying papers consist of willingness to serve statement, loyalty oath, financial disclosure, appointment of campaign treasurer form, nominating petition, etc.

A candidate may announce their candidacy prior to qualifying. However, no campaign funds may be collected or disbursed until the candidate has named a treasurer and depository and filed the appropriate form with the Town Clerk.

State law requires candidates for municipal office to comply with state regulations and accounting instructions for candidates and committees as set forth in Florida Statutes.

CHARTER REFERENDUM Information

This change to the Charter is being requested because some State agencies require that payments for the Town be made electronically.  The current wording of the Charter requires the issuance of a paper check.

Melbourne Beach Town Charter Amendment
Section 8.09, Town Charter

Currently monies can only be placed in a bank and disbursed by check.  The amendment will allow monies, except pension funds, to be placed or invested as approved by the Town Commission; provided, Florida Law is alos complied with. Money will be permitted to be disbursed by check, wire transfer abd by other means provided records are kept and directives of the Audito General and generally accepted accounting rules are followed.
