Town Commission

                                                                                    Special Call Meeting

                                                                                    November 5, 2007

 

The Town Commission of the Town of Melbourne Beach, Florida, met for a Special Call Meeting on Monday, November 5, 2007, in the Community Center, 509 Ocean Avenue, beginning at 10:00 a.m.

In attendance were Mayor William Stacey, Vice Mayor Donnie Price and Commissioners April Evans, Paul Guglietta and Sandy Wilson. Also present were Town Manager Jim Bursick, Paul Gougelman, Town Attorney, Legal Counsel Gary Sack and Town Clerk Lenore Milan.

Mayor Stacey called the meeting to order and offered the invocation.  The entire assembly recited the Pledge of Allegiance to the Flag.

 

Commissioner Wilson stated that there were signs posted in Town advising the Commission Meeting is tonight.  He inquired as to why this meeting was being held on a Monday morning.

 

Town Manager Bursick advised that several of the Commission were going to Orlando for meetings.

 

Mrs. Eugenia   705 Riverside Dr, stated she had read about the meeting and took off from work to attend.  She stated that most people of Melbourne Beach are at work, they were misled about the meeting that it was tonight.

 

Ms. Jan Futch Gilbough, 806 Oak St., stated she was aware of the meeting and took off from work; that it was posted legally, she spoke about giving 24 hours notice for the meeting.

 

Mr. Thomas Shaw, 406 Riverside Dr., spoke about settling the lawsuit, that this meeting was legally posted on the bulletin board as per the Florida Statutes and was on the Town’s website.   

 

Mr. Steve Walters, 416 6th Ave, signs posted were posted in Town, he said he had tried to have morning meetings and was criticized.  He advised that the Town Commission they should air on the side of caution.

 

Mr. Thomas Shaw, 406 Riverside Dr., stated he never complained about a morning meeting.

 

Mr. Frank Cariou, 215 Dogwood Ave, asked why the haste to have this meeting the day before the Election.

 

Mayor Stacey advised that this has been going on for months and months.

 

Ms. Xochitl Ross, 1106 Atlantic St., stated that this meeting was advertised in the newspaper, Town signs were put up in good faith.  She said this has taken a long time, both sides have been making it take a long time.  Some times requirements of the law differ from requirements of ethics, he met requirements, ethical error, signs were put out, this is one  more irregularity in a constant string of irregularities.

 

Mayor Stacey stated that there is some confusion and would take it into consideration.

 

Vice Mayor Price read a letter from Lauren Brown a 13 year-old resident of the Town.

 

Commissioner Wilson made a motion to reschedule this meeting, which was seconded by Vice Mayor Price.

 

Commissioner Evans stated that she regretted the confusion, she said she would like to hear from our Town Attorney.

 

Town Attorney Gougelman stated that there was a potential problem concerning someone who might have wanted to attend the meeting, but thought it was tonight, he said he was concerned from a legal standpoint.

 

The motion carried unanimously.

 

The meeting adjourned at 10:20 a.m.
