                                                                                    September 5, 2007

 

The Town Commission of the Town of Melbourne Beach, Florida, met for a budget public hearing on Wednesday, September 5, 2007, in the Community Center, 509 Ocean Avenue, immediately following the first public budget hearing at 7:05 P.M.

In attendance were Mayor William Stacey, Vice-Mayor Donnie Price, and Commissioners April Evans, Paul Guglietta and Sandy Wilson.  Also present were Town Manager Jim Bursick, Town Attorney Paul Gougelman, Building Official William Whitelock and Town Clerk Lenore R. Milan.

Mayor Stacey called the meeting to order and offered the invocation.  The entire assembly recited the Pledge of Allegiance to the Flag.

 

Mayor Stacey read the title for the first item on the agenda:

 

REQUEST BY TOWN ATTORNEY FOR AN EXCUTIVE SESSION REGARDING CHEVRON STATION LITIGATION.

 

Town Attorney Gougelman requested that the Commission schedule an Executive Session meeting to discuss the Chevron Station Litigation.  He provided the Commission some suggested dates.

 

Commissioner Guglietta inquired if Legal Counsel Gary Sack would be in attendance.  He was advised that we could request he be there.

 

The scheduled date would be Wednesday, September 12, 2007 at 6:30 P.M.

 

Mayor Stacey stated that the next item on the agenda was

 

Examination of petitions for town commission candidates and direction to place the names of the candidates upon the ballot pursuant to Section 13-3 of the Code of Ordinances.

 

Commissioner Wilson made a motion to approve the Petitions, which was seconded by Commissioner Guglietta.  The motion carried unanimously.

 

Mayor Stacey stated that the next item on the agenda was

 

DISCUSSION AND POSSIBLE ACTION REGARDING THE PAYMENT OF COMPENSATORY TIME FOR LT. PATRICK HARAN.

 

Mayor Stacey stated he would need to be given $9,000.

 

Commissioner Wilson made a motion to approve the payment of Compensatory Time for Lt. Pat Haran, which was seconded by Commissioner Guglietta.

 

Commissioner Wilson stated that the Lieutenant is retiring, thanked him for 18 years of service to the Town, pay him the money due to him, October 11, 2007 he takes leave, take his 432 comp hours, and pay him as if he was still working here.

 

Commissioner Wilson stated the Town would eliminate his position, that we will have a new Police Chief in Town, maybe one of the two new Sergeants in that position.  He asked how much the Town would have to pay him for his time.

 

There was a discussion regarding setting up an accrual account to pay the Lt. out of, his benefits and that the new Police Chief may call the Lieutenant in from time to time and that he still needed to be kept on the Town’s books.

 

Vice Mayor Price made a motion to approve the payment of the Compensatory time to Lieutenant Haran as requested by the Town Manager, which was seconded by Commissioner Guglietta.

 

Commissioner Wilson asked that the motion be amended that it include “at the beginning of his leave time of January 5, 2008.

 

Town Attorney Gougelman stated that the fund will take care of him until January 5, 2008, after that point the position could be eliminated, that is the way to handle it if we are funding through January 5, 2008.

 

Mr. Steve Walters, 416, 6th Ave, stated that Lt. Haran is retiring after 18 exceptional years of service.  He will take his comp time, be paid the same,  until January 5, 2008, he will no longer be an employee of the Town, the Town Manager and Police Chief could then sit down and discuss this position and then bring it back to the Town Commission with their recommendation.

 

Commissioner Wilson stated that we could move the excess from the Police Department to Contingency next budget meeting if we have those funds, until January 5, 2008 he is still employed by the Town.

 

Town Attorney Gougelman stated there were two alternatives; fund the position for the whole year, at some point Town Manager and Police Chief make a recommendation or fund until January 5, 2008.  The Police Chief and Town Manager could change it.  He stated that the key is the Lieutenant is still an employee, he continues to get benefits from the Town, which we pay.

 

Mrs. Jean Marshall, 410 6th Ave, asked if at the end of January 5, 2008, that will be all the Town owes him.

 

Town Manager Bursick advised that the Town is paying a majority of accrued vacation and sick time in 2007, with a total package of $11,500 and benefits.
