Joint Town Commission and Planning and Zoning Board Meeting

The Town Commission and the Planning and Zoning Board of the Town of Melbourne Beach, Florida, met for a Joint Meeting session on Wednesday, June 6, 2007, in the Community Center, 509 Ocean Avenue, beginning at 7:35 p.m.

In attendance were Mayor William Stacey, Vice-Mayor Donnie Price, and Commissioners April Evans and Sandy Wilson.  Absent was Commissioner Paul Guglietta.  Also present were Chairman Campbell, Members Dieterle, Clay, Schwartz and Alternate Member Quarrie.   Absent was:  Member West.  Also present were Town Manager Jim Bursick, Town Attorney Gary Sack and Town Clerk Lenore R. Milan.

Mayor Stacey called the meeting to order.  He then stated that the reason for the joint meeting was the discussion of an Ordinance providing for Breezeway requirements on oceanfront property.

Planning and Zoning Board Chairman Campbell explained the Ordinance.  He stated that we could exclude the 1-RS District.  There was a discussion regarding the use of fences for protection.

 

Member Dieterle spoke about commercial properties having to have a breezeway.  There was a discussion regarding the Breakers.

 

A resident spoke about vegetation along the dunes.

 

Chairman Campbell spoke about grandfathering in existing structures.

 

Mr. John Hartley, 307 Oak St. stated that his engineer reviewed the Ordinance, that it should be clarified that it does not apply to the 1-RS District. He said the Florida Department of Environmental Protection has no requirement within property lines.

 

The Attorney representing the Breakers spoke about the non-conforming structures, that the Ordinance repeals all conflicting Ordinances or parts thereof.

 

Mr. Djon Pepaj said that when he sits at his restaurant there is a great breeze, river to ocean.

 

Mrs. Martha Remark, 707 Atlantic St., stated she has researched the County’s breezeway requirements and that they are regulated by the State.

 

Mr. Jose Hixon, 103 Oak St., spoke about his fence into permitted floor ratio, that his neighbors on the other side appreciate this fence, we block the wind.  He also reminded about keeping it dark at the beach for the turtles.

 

Mr. Sean Murphy, 1211 Atlantic St., spoke about his property being converted from 5-RMO to

1-RS, being grandfathered and that it all has to be uniform.

 

Ms. Diane Hines, 603 Atlantic St., said to leave out residential properties.

 

Commissioner Wilson recommended that the floor to area ratio (FAR) be for footprint size on lots in 1-RS, FAR should be used Town-wide. He said if it is put on 1-RS, 30% setbacks needed to be looked at all over Town.

 

Vice Mayor Price said we should seriously look into making sure it does not include 1-RS.

 

Mr. Sean Murphy, 1211 Atlantic St., advised that this Ordinance was taken from another town. 

 

Vice Mayor Price made a motion to adjourn the meeting, which was seconded by Commissioner Evans.  

 

The meeting adjourned at 8:40 p.m.
