Board of Adjustment

The Board of Adjustment of the Town of Melbourne Beach, Florida met in Special session on Thursday, April 5, 2007 in the Community Center, 509 Ocean Avenue, beginning at 6:30 p.m.

 

Present were Chairman Robert Schaefer, Vice Chairman Wildman and Members Xochitl Ross, Gail Gowdy, and Charles Tennant. Also in attendance were Town Manager Jim Bursick, Planning Official Dennis Ragsdale, Town Attorney Gary Sack, Building Official William Whitelock and Town Clerk Lenore Milan. Alternate Member Lou Failla was in the audience. Steven Schwartz, Planning and Zoning Board Liaison entered late.

 

Chairman Schaefer called the meeting to order. 

 

The first item on the agenda was the re-hearing of variance application 08-2006 for the

Chevron Station.

 

Chairman Schaefer stated that due to writ by the applicant, this re-hearing should be moved to another date.

 

Town Attorney Sack stated that this request be made on behalf of the applicant.  He said the legal proceeding filed doesn’t preclude the re-hearing request.

 

Mr. Stelling stated that he agreed with continuing.

 

Town Attorney Sack stated that the two were not related.

 

Chairman Schaefer made a motion to continue this until May 24, 2007, at the request of the applicant, which was seconded by Vice Chairman Wildman. 

 

Vice Chairman Wildman advised that it was always for the best to give the applicant the opportunity to prepare, nothing detrimental to continue the meeting.

 

Mr. Stelling was sworn-in, requested that the Board delay this until there was a court ruling, and that a ruling not be made by that date. 

 

Chairman Schaefer advised that it had to be continued to a specific date.

 

Ms. Laura Minton-Young, of Dean Mead, who represented Mr. and Mrs. Terry Williamson, 316 First Ave, advised that she agreed with the date certain, that it would give the applicant time to prepare.

 

The motion carried 4-1, with Member Gowdy voting nay.

 

The meeting adjourned at 6:45 P.M.
